MakeMeMine is a curated marketplace, educational platform, and community designed to help people discover intimate apparel, learn about their bodies, connect with thoughtful brands, and explore confidence through meaningful experiences.

These Terms of Service ("Terms") explain the rules that apply when you visit, browse, create an account, purchase products, submit content, communicate with us, or otherwise use the MakeMeMine website, applications, products, and services (collectively, the "Services").

By accessing or using MakeMeMine, you confirm that you have read, understood, and agree to be legally bound by these Terms, our Privacy Policy, and any additional policies referenced throughout our Services. If you do not agree, you must not use MakeMeMine.

MakeMeMine Ltd. ("MakeMeMine", "we", "our", or "us") operates a curated multi-brand marketplace that connects customers with independent and established brands offering intimate apparel and related products.

MakeMeMine may also provide editorial content, educational resources, community experiences, AI-assisted features, inspiration galleries, and other services designed to enhance the customer experience.

Unless expressly stated otherwise, MakeMeMine is not the manufacturer of products offered by independent brand partners.

By using MakeMeMine, you confirm that:

• You are legally capable of entering into a binding agreement.
• You will comply with these Terms and all applicable laws.
• The information you provide is accurate and truthful.
• You will not use the Services for unlawful, fraudulent, or abusive purposes.

If you use MakeMeMine on behalf of a business or other legal entity, you represent that you have authority to bind that organization to these Terms.

"Account" means a registered MakeMeMine customer or brand account.

"Brand" means an approved business, designer, manufacturer, or seller authorized to offer products through MakeMeMine.

"Content" includes text, photographs, graphics, videos, reviews, comments, stories, designs, AI-assisted material, trademarks, logos, and other information appearing on the Services.

"Customer" means an individual who browses, creates an account, purchases products, or otherwise uses the Services.

"Marketplace" means the MakeMeMine platform through which approved brands offer products to customers.

"Services" means the website, mobile experiences, community features, educational resources, customer support, and other services provided by MakeMeMine.

"User" means any visitor, customer, brand representative, or other person accessing the Services.

You must be at least 16 years of age or the minimum legal age required in your jurisdiction to use our Services without parental consent.

We may refuse access, suspend accounts, or terminate Services where eligibility requirements are not met.

Creating an account may allow access to order history, saved preferences, wishlists, community participation, and personalized experiences.

You are responsible for:

• Maintaining the confidentiality of login credentials
• Restricting access to your account
• Keeping information accurate and current
• Promptly notifying us of suspected unauthorized use

You remain responsible for activity through your account except where applicable law provides otherwise. We may suspend or terminate accounts that violate these Terms or pose a security risk.

MakeMeMine operates as a curated marketplace. Brands cannot automatically sell through our platform and may be reviewed before acceptance.

Acceptance does not constitute certification, an unconditional endorsement, or a guarantee of any particular product or brand. Individual products remain the responsibility of the relevant brand except where applicable law provides otherwise.

MakeMeMine may approve, decline, suspend, or remove brands in accordance with its agreements, policies, and lawful business judgment.

We may introduce, modify, suspend, or discontinue features, functionality, content, or portions of the Services. Where reasonably practical, we will provide notice of material changes that significantly affect users.

We are not liable for reasonable interruptions caused by maintenance, upgrades, security improvements, third parties, or events beyond our control.

When you place an order through MakeMeMine, you make an offer to purchase products from one or more approved brand partners through our marketplace.

Orders are subject to acceptance and product availability. An order-confirmation email acknowledges receipt but may not constitute final acceptance.

We or the relevant brand may decline or cancel an order because of:

• Product unavailability
• Pricing or listing errors
• Suspected fraud
• Payment authorization failure
• Violation of these Terms
• Shipping restrictions
• Legal or regulatory requirements

If payment was collected for an order that cannot be fulfilled, an appropriate refund will be processed in accordance with the Refund Policy and applicable law.

We make reasonable efforts to present accurate product descriptions, pricing, sizing information, images, colours, availability, and other details.

However:

• Colours may vary by screen or device.
• Measurements may include reasonable manufacturing tolerances.
• Availability may change without notice.
• Some product information is provided by brands.

If a product is listed at an incorrect price or with a material error, we may cancel or refuse the affected order before shipment. Where practical, we may offer the option to proceed with corrected information.

Products are subject to availability and inventory is not guaranteed until an order is accepted and confirmed.

We may limit purchase quantities where reasonably necessary to prevent fraud, abuse, or unauthorized resale.

Payments are processed through secure third-party payment providers.

By submitting payment information, you represent that:

• You are authorized to use the payment method.
• The information is accurate.
• Sufficient funds or credit are available.

MakeMeMine does not store complete payment-card information. Payment providers may apply their own terms, privacy policies, fraud-prevention procedures, and verification requirements.

Applicable taxes, duties, shipping charges, and mandatory fees will be calculated and displayed where reasonably possible.

Customers are responsible for customs duties, import taxes, brokerage fees, or similar governmental charges imposed by their jurisdiction unless expressly stated otherwise.

Shipping times are estimates and are not guaranteed unless expressly stated.

Actual delivery may vary because of carrier delays, customs inspections, weather, holidays, supply-chain disruptions, incorrect shipping information, or events beyond reasonable control.

Risk of loss and title transfer shall be determined by applicable law and the terms communicated during checkout. Additional details appear in our Shipping Policy.

Returns, exchanges, and refunds are governed by our Returns Policy and Refund Policy, which form part of these Terms.

Due to the intimate nature of many products, certain items may be ineligible for return for hygiene, health, or safety reasons where permitted by law.

Nothing in these Terms limits mandatory consumer rights that cannot legally be excluded.

You agree to:

• Provide truthful and accurate information.
• Keep account information current.
• Respect brands, customers, and community members.
• Use the Services only for lawful purposes.
• Review product sizing and descriptions before ordering.
• Protect account credentials.
• Comply with applicable laws.

You must not:

• Impersonate another person or organization.
• Scrape or harvest data without authorization.
• Interfere with website security.
• Introduce malware or harmful code.
• Circumvent technical protections.
• Engage in fraudulent purchasing behaviour.
• Abuse support staff.
• Post unlawful, defamatory, threatening, discriminatory, exploitative, or misleading content.
• Violate intellectual-property or privacy rights.

MakeMeMine may provide fitting guidance, body education, lingerie-care information, and sizing resources for general educational purposes.

Such content is not medical, psychological, therapeutic, legal, or other professional advice. Users should seek qualified guidance appropriate to their circumstances.

MakeMeMine may use artificial intelligence or machine learning for product recommendations, search assistance, educational support, customer service, moderation, personalization, or future features.

AI outputs may be inaccurate, incomplete, or unsuitable for a particular purpose and do not replace independent judgment or professional advice.

Story Room is a community space where users may share personal experiences, reflections, thoughts, and stories.

By submitting content, you acknowledge that:

• You are responsible for it.
• It does not violate law or another person's rights.
• It does not contain confidential information you do not wish to share.
• It complies with our Community Guidelines.

Story Room is not a venue for emergency assistance or professional medical, legal, or psychological advice. We may review, edit for formatting, refuse, restrict, or remove submissions that violate our policies or law.

Between Us is intended to encourage respectful conversation. Harassment, bullying, discrimination, threats, hate speech, sexually exploitative behaviour, spam, or abuse is prohibited.

We may moderate discussions and remove content or restrict access where reasonably necessary.

Ways of Desire allows users to share inspiration, concepts, ideas, and creative submissions.

Unless expressly agreed in writing, submission does not create a partnership, employment relationship, fiduciary relationship, or expectation that MakeMeMine or a brand will manufacture, purchase, license, or compensate the submission.

If a concept is pursued commercially, rights, compensation, licensing, attribution, or collaboration will be governed by a separate written agreement.

Do not submit confidential information or trade secrets unless protected by a separate agreement.

You retain ownership of original content you submit.

By submitting content, including stories, comments, ideas, reviews, photographs, videos, or other materials, you grant MakeMeMine a worldwide, non-exclusive, royalty-free, transferable, and sublicensable licence to:

• Display and store the content
• Reproduce and publish it
• Translate it
• Adapt formatting where necessary
• Promote the Services using it
• Moderate, edit, restrict, or remove it where reasonably necessary

This licence exists for operating, improving, administering, and promoting MakeMeMine. You represent that you have the necessary rights to submit the content.

Unless otherwise indicated, the MakeMeMine name, logos, branding, website design, educational library, graphics, illustrations, original copy, editorial content, software, user interface, layouts, icons, videos, and animations are owned by or licensed to MakeMeMine Ltd. and protected by applicable law.

No ownership is transferred to users. Except where permitted by law or written authorization, users may not copy, reproduce, distribute, modify, reverse engineer, publicly display, or commercially exploit MakeMeMine intellectual property.

Each brand retains ownership of its trademarks, logos, product photography, product descriptions, packaging, brand names, marketing materials, and other proprietary content.

Users may not reproduce or commercially exploit brand content without authorization.

Customers may submit honest reviews based on genuine experiences. Reviews must be accurate, respectful, relevant, and truthful.

Reviews must not contain defamatory statements, false information, spam, undisclosed paid promotion, personal attacks, or another person's personal information.

We may moderate reviews that violate these Terms or law and do not guarantee publication of every review.

MakeMeMine may review submissions, remove content, edit formatting, restrict visibility, suspend accounts, terminate accounts, preserve evidence, or report unlawful conduct where required.

Moderation is carried out in good faith to protect safety, integrity, and community quality. We are not obligated to monitor every submission and cannot guarantee immediate removal of all objectionable content.

If you believe content infringes copyright or other intellectual-property rights, contact us with:

• Contact information
• A description of the protected work
• Identification and location of the allegedly infringing material
• A good-faith statement that the use is unauthorized
• A statement that the information is accurate
• Evidence of ownership or authority where appropriate

We may remove or restrict material during review. Knowingly false claims may result in account or legal consequences.

We may suspend, restrict, or permanently terminate access where we reasonably believe a user has:

• Violated these Terms or law
• Engaged in fraud
• Compromised security
• Infringed rights
• Repeatedly breached Community Guidelines
• Misused community features
• Submitted false information
• Created significant risk to users, brands, or MakeMeMine

We may provide notice where appropriate, but immediate action may be taken where necessary. Termination does not cancel outstanding obligations or provisions intended to survive termination.

The Services may integrate with payment processors, carriers, authentication providers, email providers, analytics services, social platforms, brand websites, or other third parties.

These services operate independently and may have their own terms and privacy practices. MakeMeMine is not responsible for matters outside its reasonable control.

To the fullest extent permitted by law, the Services are provided on an "as is" and "as available" basis.

We do not guarantee uninterrupted or error-free service, permanent product availability, complete accuracy of community or educational content, or accuracy of AI outputs.

Nothing excludes warranties or rights that cannot legally be excluded.

To the maximum extent permitted by law, MakeMeMine Ltd. and its directors, officers, employees, contractors, affiliates, licensors, and service providers will not be liable for indirect, incidental, consequential, exemplary, punitive, or special damages arising from:

• Use or inability to use the Services
• Product availability
• Delivery delays
• Third-party conduct
• Community submissions
• AI-generated content
• Website interruptions
• Technical failures
• Data loss beyond reasonable control

Where liability cannot be excluded, it is limited to the maximum extent permitted by law. Mandatory statutory consumer rights remain unaffected.

To the extent permitted by law, you agree to indemnify and hold harmless MakeMeMine Ltd. and its directors, officers, employees, contractors, affiliates, licensors, and service providers from claims, losses, liabilities, damages, costs, or reasonable legal expenses arising from:

• Your breach of these Terms
• Your unlawful conduct
• Your violation of another person's rights
• Content you submit
• Misuse of the Services

MakeMeMine is not responsible for delays or failures caused by events beyond reasonable control, including natural disasters, fire, flood, epidemics, government action, labour disputes, internet outages, cybersecurity incidents, utility failures, war, civil unrest, or transportation disruption.

Affected obligations may be delayed for the period reasonably required.

These Terms are governed by the laws of Ontario and applicable federal laws of Canada, without regard to conflict-of-law principles.

Where permitted, disputes are subject to the courts located in Ontario, Canada. Mandatory consumer rights and jurisdictional protections remain unaffected.

We may update these Terms to reflect changes in Services, legal requirements, business operations, or user experience.

We will revise the "Last Updated" date and provide additional notice where appropriate. Continued use after the effective date constitutes acceptance where permitted by law.

If a provision is held invalid or unenforceable, the remaining provisions remain in effect.

These Terms, together with our Privacy Policy, Returns Policy, Refund Policy, Shipping Policy, Cookie Policy, Community Guidelines, and policies incorporated by reference, constitute the agreement between you and MakeMeMine regarding the Services and supersede prior understandings on the same subject.
